Council of States committee in favor of stalking penalties

The responsible Council of States committee is in favor of a stalking offence. However, unlike its sister committee in the National Council, it does not want this to be a successful offense, but an endangering offense. This means that the perpetrator does not have to have restricted the victim's lifestyle.
In addition, the Legal Affairs Committee of the Council of States (RK-S) followed the Federal Council's proposal to establish the offense exclusively as an application offense. Its counterpart in the Council of States voted 7 to 2 in favor of the entire proposal of the National Council committee, as reported by the parliamentary services on Wednesday.
Before making its decision, the Legal Affairs Committee consulted representatives of the cantons, the Conference of Public Prosecutors and the Bar Association. It hopes that the inclusion of stalking or stalking will provide better protection for victims.
Unlike the Federal Council and the National Council Committee, the Council of States Committee does not want to define stalking as a successful offense. It wants to define stalking as an endangering offense. This would make stalking punishable, regardless of whether it restricts the victim's life or not.
