Councils disagree on detention of repeat offenders

The Council of States does not want systematic detention for repeat offenders of serious crimes. It also rejects increasing the maximum sentence for murder under juvenile criminal law from four to six years.
On Wednesday, the small chamber maintained two important differences in the revision of the Criminal Code and the Juvenile Penal Code.
With regard to the detention of adult repeat offenders, the small chamber followed the proposal of the advisory committee without opposition.
In February, the National Council extended the conditions for detention. According to the Grand Chamber, these should also be issued for people who have committed murder, intentional homicide or rape for the second time.
However, the Legal Affairs Committee of the Council of States assumed that such an automatic procedure would not be compatible with the European Convention on Human Rights. The matter will return to the National Council.
