National Council committee wants to tighten rules for prison leave

Persons in custody and offenders undergoing inpatient therapeutic measures should not be granted unaccompanied leave in future. This is the opinion of the responsible National Council committee. It has submitted an initiative to this effect.

In the summer session, the National Council rejected new rules for the enforcement of measures in adult criminal law in the final vote. Now the National Council's Legal Affairs Committee (RK-N) wants to "initiate a comprehensive revision in the area of the execution of sanctions", as reported by the parliamentary services on Friday.

Accordingly, offenders who are in the closed execution of custody or the preceding custodial sentence should not be allowed to be released unaccompanied on vacation. The same should apply to offenders who are undergoing inpatient therapeutic treatment for serious offenses.

In addition, custody is only to be reviewed ex officio every three years if conditional release has previously been refused three times in succession. Finally, the composition of the expert commission for assessing dangerousness and the definition of dangerousness of offenders is to be adjusted.

The sister committee of the Council of States (RK-S) will next deal with the corresponding parliamentary initiative. If it approves the initiative, the RK-N can prepare a draft decree.
