New rules for cross-border inheritance cases will apply from 2025

From the beginning of next year, new rules for cross-border inheritance matters will apply in Switzerland. The Federal Council has brought the amendments to the Federal Act on Private International Law (PILA) into force on January 1, 2025.

The revision gives people who have assets both in Switzerland and abroad additional options for arranging their inheritance. The Federal Council wrote this in a press release on Wednesday.

The improvements are all the more important as more and more people are operating in an international context, both professionally and privately. This is why the number of international inheritance matters has also increased.

According to the communiqué, the revised law adapts Swiss regulations to developments abroad and modernizes Swiss law. The new provisions reduce the risk of conflicts of jurisdiction and contradictory decisions by the competent authorities.

According to parliamentary documents, this includes cases in which someone moves abroad after retirement, dies there and leaves assets both in Switzerland and at their last place of residence. In December 2023, the National Council and Council of States resolved the final differences in the revision of the aforementioned law.
