Switzerland convicted of deporting a homosexual Iranian man

Switzerland has violated the ban on inhumane treatment by deporting a homosexual Iranian. The European Court of Human Rights awards the complainant compensation of 7,000 euros for his costs.

The man was insulted and beaten by his family because of his sexual orientation. In 2019, he applied for asylum in Switzerland. The State Secretariat for Migration did not consider his story credible and rejected his application. The Federal Administrative Court confirmed this decision.

In its decision published on Tuesday, the court in Strasbourg reached a different verdict. In it, the court takes the view that the complainant has been subjected to inhumane treatment by his family, third parties or even by the Iranian state as a result of the deportation order. The prohibition of such treatment in Article 3 of the European Convention on Human Rights would therefore be violated.
