On Monday, a second expert testified before the District Court of Dielsdorf, highlighting Brian's recent progress in Zurich Prison in a positive light. The 28-year-old is now said to be well-adjusted, polite, and respectful. However, any potential release would still be considered a "big experiment".
The expert said of Brian, who has been living in Zurich prison for nearly two years and is no longer in solitary confinement, that he can adapt to situations but he is not a different person.
In May, Brian's personality structure remained unchanged despite his ability to form social contacts and accept a "no". This was demonstrated when the supervisors confiscated Brian's phone, as he made threats and damaged property, but did not attack people. Despite this progress, Brian has refused therapy, indicating that his personality structure has not changed.
The discussion about a life "outside" is being held in Dielsdorf court because the most serious charge against him in the new trial is an attempted serious bodily injury. Even the expert could not answer what such a life "outside" would mean.
The District Court did not classify the throwing of a shard of glass towards a guard as an attempted serious bodily injury, leaving no offenses that would justify a prison sentence.
Brian is facing charges for 30 offenses allegedly committed in the prison of Pöschwies. His lawyers argue that the harsh conditions of detention were the cause of the attacks.
