Trial of Former Basel National Councillor

Two former Basel National Council members and their former boss and party colleague are due to appear in court on Friday to face charges of "fraudulent founding" of companies. According to the indictment of the prosecution, the two are accused of obtaining false documents and instigating forgery. Between 2007 and 2009, the two allegedly acted in eight cases in the same way, as stated in the indictment. As the head of the trust company, a former Basel Grand Council member allegedly informed the trade register keeper that all contributions for the newly founded companies had been fully paid. After the registration in the commercial register, the defendants allegedly transferred the founding capital of 100,000 francs back to the trust company in whole or in part in order to use it for the founding of other companies or for other purposes. The two defendants are said to have transferred the founded companies to their customers as so-called shell companies. The indictment has been in place since 2018 and is only now coming to court. The reason for the delay is that the court president responsible for the case retired at the end of 2021 without instructing the case. A new process manager was appointed in 2022 and had to familiarize himself with the dossier. A notary is also charged with forgery. The defendants are said to have instigated him to do so. All three are presumed innocent until the verdict is passed.nnnnnnnnnn
