Withdrawal of former Deloitte director’s license still open

The former managing director of the consulting firm Deloitte has won a victory before the Federal Supreme Court. In the proceedings to revoke his license as an audit expert and auditor in the banking and finance sector, the lower court failed to hold a public hearing. It must now do so.
The case is therefore being returned to the Federal Administrative Court at the behest of Switzerland's highest court. This is the result of a ruling published by the Federal Supreme Court on Wednesday. The court upheld the appeal of the former Deloitte director. Contrary to the view of the lower court, the latter was not allowed to reject the former managing director's request for a public hearing.
In 2022, the Federal Administrative Court confirmed the withdrawal of the licenses as ordered by the Federal Audit Oversight Authority. However, it reduced the duration from four to three years.
Following an audit, the audit supervisory authority accused the director of having seriously violated numerous regulations in the area of auditing and auditing and of having been uncritical in this context. The Federal Administrative Court must now re-examine these issues. (Judgement 2C_384/2022 of 14.11.2023)
